Please read these Terms and Conditions carefully. By requesting services from, booking travel through, submitting payment to, or otherwise engaging with True Memories Travel, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
For purposes of these Terms and Conditions, “True Memories Travel,” “TMT,” “we,” “us,” and “our” refer to True Memories Travel. “Client,” “traveler,” “passenger,” “you,” and “your” refer to the person(s) requesting services, traveling, making payment, and/or authorizing travel arrangements.
1. Agency Role
True Memories Travel acts solely as an independent travel advisor and intermediary for third-party travel suppliers, including but not limited to cruise lines, hotels, resorts, airlines, transfer providers, tour operators, insurance providers, and other travel service vendors.
TMT does not own, operate, manage, supervise, or control any third-party supplier and is not responsible for any act, omission, error, default, breach, delay, cancellation, injury, loss, damage, accident, inconvenience, overbooking, financial default, or other failure of any supplier.
All transportation, accommodations, products, and services are subject to the terms, conditions, policies, and limitations imposed by the applicable supplier(s). By authorizing us to arrange travel on your behalf, you agree to be bound by all such supplier terms and conditions.
2. Scope of Services
True Memories Travel specializes in premium, luxury, and group cruise experiences.
Unless otherwise stated in writing, individual cruise bookings do not require a planning fee.
For group cruise bookings with 5 or more cabins booked, a non-refundable group coordination fee applies based on the number of cabins booked. Current group coordination fees are:

5 to 8 cabins: $125

9 to 24 cabins: $250
-
25 or more cabins: $350
No group coordination fee applies to bookings with fewer than 5 cabins.
If the number of cabins booked moves into a higher fee tier after the initial fee has been paid, the additional difference in the applicable fee will be charged.
Any applicable group coordination fee will be discussed and agreed to in writing before services begin.
TMT reserves the right, in its sole discretion, to decline any inquiry, booking request, or service relationship.
3. Accuracy of Information
You represent and warrant that all information you provide to TMT, including legal names, dates of birth, contact information, travel preferences, and payment information, is complete and accurate.
You are solely responsible for verifying the accuracy of all itineraries, confirmations, invoices, statements, names, travel dates, cabin categories, and other booking details immediately upon receipt. Any error or discrepancy must be reported to TMT promptly in writing.
TMT is not responsible for losses, denied boarding, missed travel, change fees, cancellation penalties, or other costs arising from inaccurate, incomplete, or untimely information provided by you or not promptly corrected by you.
4. Pricing and Availability
All prices, quotes, promotions, offers, inclusions, cabin categories, availability, and supplier inventory are subject to change at any time without notice until a deposit or payment has been made and accepted by the supplier and the booking is confirmed.
Quoted prices may not include, unless specifically stated otherwise in writing, airfare, baggage fees, gratuities, seat assignments, excursions, travel insurance, resort or port fees, taxes, transfers, hotel incidentals, or other personal expenses.
TMT does not guarantee that any quoted fare, promotion, stateroom, itinerary, or availability will remain available until booked and confirmed.
5. Deposits, Payments, and Final Payment
Deposits and final payments are due in accordance with the applicable supplier’s terms and any payment schedule provided by TMT.
Failure to make payment by the required due date may result in cancellation of the booking, loss of space, increase in pricing, loss of promotional offers, and forfeiture of funds previously paid. TMT is not responsible for any loss arising from missed payment deadlines.
You authorize TMT and/or the applicable supplier to process payments you approve for deposits, final balances, change fees, cancellation fees, supplier penalties, insurance premiums, and other travel-related charges you authorize.
If a payment is declined, reversed, disputed, or otherwise unpaid, TMT reserves the right to suspend or terminate services and cancel pending arrangements, subject to supplier rules and penalties.
6. Cancellations and Refunds
All cancellation requests must be submitted to TMT in writing by email. A booking is not considered canceled until written confirmation of cancellation has been issued by TMT or the supplier, as applicable.
If you cancel, supplier cancellation penalties will apply according to the supplier’s terms and conditions. Some bookings may be fully non-refundable from the time of booking.
In addition to any supplier penalties, True Memories Travel charges a $75 per person cancellation fee for all client-initiated cancellations, regardless of whether travel insurance was purchased. This fee is separate from and in addition to any supplier-imposed cancellation penalties.
Refunds, if any, are subject exclusively to the policies, timelines, calculations, and determinations of the applicable supplier and/or travel insurance provider. TMT does not control supplier refund processing times and is not responsible for refund delays, denials, partial refunds, future travel credits, or supplier determinations regarding refund eligibility.
7. Changes to Confirmed Bookings
Any request to modify a confirmed booking, including but not limited to changes in names, travel dates, cabin categories, occupancy, flights, transfers, or other travel components, is subject to supplier approval, supplier rules, availability, applicable fare differences, and supplier-imposed penalties.
TMT is under no obligation to secure requested changes and does not guarantee that any change can be made.
If TMT agrees to assist with changes, additional service fees may apply and must be paid before change requests are processed, if applicable.
8. Group Travel Terms
Group travel may be subject to separate contracts, pricing structures, deposit schedules, cancellation deadlines, supplier requirements, cabin minimums, amenity thresholds, promotional conditions, and attrition terms.
If supplier minimums, cabin thresholds, or participation requirements are not met, supplier pricing, group amenities, onboard credits, tour concessions, or other group benefits may be modified, reduced, or withdrawn.
If a group sailing or group arrangement is canceled or materially changed by the supplier, any refund, credit, or alternative arrangement will be governed solely by the supplier’s policies and applicable contract terms. TMT is not responsible for supplier decisions regarding cancellation, compensation, re-accommodation, or future travel credit.
9. Travel Insurance
Travel insurance is strongly recommended for all travelers.
Unless specifically stated in writing, travel insurance is not included in quoted pricing and is not automatically included with your booking.
Travel insurance is a contract between you and the insurance provider. Coverage, exclusions, benefits, limitations, and claim determinations are governed solely by the policy issued by the insurance provider. TMT does not guarantee coverage, claim approval, or reimbursement and is not liable for any denied claim or policy limitation.
If you decline travel insurance, you acknowledge that you may be personally responsible for cancellation penalties, supplier penalties, medical expenses, evacuation costs, travel interruption losses, baggage losses, and other travel-related expenses or losses.
10. Travel Documents and Entry Requirements
You are solely responsible for obtaining, carrying, and maintaining all required travel documents, including but not limited to passports, visas, vaccination records, parental consent forms, identification, and any other documents required by the supplier(s), destination(s), transit location(s), or applicable government authorities.
Your legal name on all booking records must exactly match the name on your government-issued identification and travel documents.
Passport and entry requirements vary by destination and supplier. Many destinations require passport validity extending beyond the dates of travel. It is your responsibility to verify all documentation, entry, exit, health, and transit requirements applicable to your itinerary.
TMT is not responsible for denied boarding, denied entry, missed embarkation, missed flights, delayed travel, canceled travel, or additional costs resulting from incorrect, expired, missing, insufficient, or non-compliant travel documentation.
11. Health, Safety, and Travel Requirements
You are solely responsible for understanding and complying with all health, vaccination, testing, screening, embarkation, entry, exit, and travel requirements applicable to your itinerary.
Such requirements may change at any time and without notice. TMT is not responsible for any delay, denial of boarding, denial of entry, quarantine, isolation, missed travel, cancellation, added expense, or other loss arising from changes to health rules, travel advisories, local regulations, supplier requirements, or government action.
12. Airfare and Air Schedule Changes
If airfare is arranged as part of your travel, all air reservations are subject to airline rules, schedule changes, delays, cancellations, re-accommodation, seat assignment changes, baggage policies, fare increases, and airport or airline operational decisions.
TMT is not responsible for missed connections, schedule changes, route changes, seat reassignments, baggage fees, baggage loss, denied boarding, or any airline-related disruption.
You are responsible for reviewing all flight details upon receipt and reconfirming flight schedules directly with the airline prior to departure.
13. Supplier Changes and Itinerary Modifications
Suppliers may substitute ships, ports of call, schedules, accommodations, transportation, excursions, and other itinerary components at any time and without prior notice.
TMT is not responsible for any supplier substitution, itinerary modification, port cancellation, schedule adjustment, change in onboard experience, or reduction in supplier amenities or services.
Any compensation, refund, or credit relating to such changes, if any, is solely within the discretion of the supplier and governed by the supplier’s policies.
14. Force Majeure
TMT shall not be liable for any delay, cancellation, loss, injury, damage, expense, or disruption arising from any event beyond its reasonable control, including but not limited to severe weather, hurricanes, natural disasters, floods, fires, earthquakes, acts of God, epidemics, pandemics, disease outbreaks, government actions, border closures, travel bans, supplier insolvency, labor disputes, civil unrest, war, terrorism, transportation interruptions, or similar events.
In any such event, refunds, credits, rebooking options, or compensation, if any, shall be governed solely by the applicable supplier’s policies and/or the terms of any travel insurance policy purchased.
15. Limitation of Liability
To the fullest extent permitted by law, TMT shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of enjoyment, emotional distress, lost wages, missed connections, missed excursions, denied boarding, illness, injury, death, property loss, baggage loss, travel interruption, or financial loss arising out of or related to any travel booking, travel service, supplier act or omission, or event beyond TMT’s control.
Without limiting the foregoing, TMT’s maximum liability to you for any claim arising from services provided by TMT shall not exceed the amount of service fees actually paid directly to TMT for the specific booking at issue, excluding all amounts paid to third-party suppliers.
16. Chargebacks and Payment Disputes
You agree not to initiate a chargeback or payment dispute for any charge that was authorized by you and properly processed for travel services, supplier deposits, supplier balances, insurance premiums, cancellation fees, or other agreed charges.
In the event of an improper or unjustified chargeback, reversal, or payment dispute, you remain responsible for all amounts due, including supplier penalties, agency fees, administrative costs, collection costs, and reasonable attorney’s fees and expenses to the extent permitted by law.
TMT reserves the right to provide these Terms and Conditions, invoices, payment authorizations, communications, and booking records to the payment processor, supplier, financial institution, or dispute resolution entity in response to any dispute or chargeback.
17. Electronic Communications and Signatures
You consent to receive communications, invoices, confirmations, authorizations, notices, and travel documents electronically. Electronic acceptance, electronic signatures, and payment authorizations shall be deemed binding and enforceable to the fullest extent permitted by law.
18. No Guarantee of Supplier Performance
TMT makes no warranty or representation regarding the financial condition, conduct, safety, quality, suitability, or performance of any supplier.
The fact that TMT offers or arranges travel with a supplier does not constitute a representation or warranty by TMT that the supplier will perform as promised or that travel with that supplier is without risk.
19. Indemnification
You agree to indemnify, defend, and hold harmless TMT and its owners, agents, contractors, affiliates, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorney’s fees, arising out of or related to your breach of these Terms and Conditions, your acts or omissions, your failure to comply with supplier or governmental requirements, or your initiation of an improper payment dispute or chargeback.
20. Governing Law and Venue
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms and Conditions or services provided by TMT shall be brought exclusively in the state or federal courts serving Wake County, North Carolina, and you consent to the personal jurisdiction and venue of such courts.
21. Severability and Waiver
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
No waiver by TMT of any provision, right, breach, or default shall be deemed a continuing waiver of any other provision, right, breach, or default.
22. Entire Agreement
These Terms and Conditions, together with any written quote, invoice, authorization, supplier terms, and other written documents expressly incorporated by reference, constitute the entire agreement between you and TMT concerning the services provided for the booking at issue.
23. Acknowledgment
By booking with TMT, you acknowledge and agree that:

you have read and understand these Terms and Conditions;

you understand that TMT acts solely as an intermediary and not as the provider of travel services;

you are responsible for making payments on time and complying with supplier deadlines;

you are responsible for obtaining and carrying valid travel documents and meeting all entry and health requirements;

supplier terms, penalties, and restrictions apply to your booking;

pricing and availability may change until booked and confirmed;

travel insurance has been recommended to you;

True Memories Travel charges a $75 per person cancellation fee for client-initiated cancellations;

for group cruise bookings with 5 or more cabins, a non-refundable group coordination fee applies based on the number of cabins booked;

no group coordination fee applies to bookings with fewer than 5 cabins;

you authorize approved charges related to your travel arrangements; and

you accept these Terms and Conditions in full.
